New York City Mayor Zohran Mamdani has conceded that the city lacks the legal capability to detain Israeli Prime Minister Benjamin Netanyahu should he visit the United States later this year. This acknowledgment comes after Mamdani’s administration explored potential legal avenues regarding the International Criminal Court’s (ICC) arrest warrant for Netanyahu but ultimately determined that New York City does not possess the authority to enforce it.
Despite the limitations, Mayor Mamdani has urged the US federal government to acknowledge the ICC warrant and take appropriate action. He labeled Netanyahu a war criminal, declaring that the Israeli leader, along with any other person facing similar allegations, is not welcome in New York City.
Netanyahu is anticipated to be in New York this September to participate in the United Nations General Assembly. During his mayoral campaign, Mamdani had vowed to investigate options for enforcing the ICC warrant if the Israeli prime minister entered the city.
The ICC issued an arrest warrant for Netanyahu in 2024 over alleged war crimes. However, the United States does not recognize the ICC’s jurisdiction and is not a member of the court. In response to Mamdani’s comments, US President Donald Trump criticized the mayor’s stance, asserting that Netanyahu would not be arrested on American soil and defending his actions.
In reaction to the controversy, Netanyahu has expressed little concern over the mayor’s remarks, dismissing them outright. The developments underscore the complexities of international law and the limitations faced by local authorities in matters involving foreign leaders and global judicial bodies.
